Who is in Charge of the Probate Process?

When someone passes away, their belongings — like their home, car, bank accounts, and personal items — need to be passed on to the heirs (unless there is a revocable living trust or beneficiary designations on the assets). This is done through a process called probate. But who’s in charge of making sure that happens?

The person in charge is usually called the personal representative. You might also hear people say “executor” — it means the same thing. This is the person who handles the details of settling the estate.

How Does Someone Get That Role?

If the person who passed away had a will, they named someone they trust to handle the estate. That person is appointed by the court to serve as the personal representative.

If there is no will, the court will choose someone — usually a close family member — to take on the role.

What Does the Personal Representative Do?

This person has a big job, including:

  • Gathering important documents like the will and death certificate
  • Filing the case in court
  • Making a list of the person’s belongings and debts
  • Notifying creditors and paying valid bills
  • Filing and paying taxes
  • Managing or selling property, if needed
  • Distributing what’s left to the heirs

They’re also responsible for keeping records and making sure everything is done properly. Most probates take at least one year from start to finish, if not longer.

Can the Personal Representative Get Help?

Yes! Most people in this role work with a lawyer to guide them through the probate process. There’s a lot to keep track of, and legal help can make things less stressful.
